10. Disputes, Governing Law, and Arbitration


Step 1 — Contact us first. If you have a concern, email us at support@elmiur.com. Most issues are resolved quickly this way.

Step 2 — Formal notice. If we cannot resolve it informally, you agree to send a written Pre-Dispute Notice to "ELMIUR Legal Department" at our registered address at least 35 days before taking any further action. Your notice must include your name, signature, date, a description of the dispute, and the resolution you're seeking.

Step 3 — Arbitration. If the dispute remains unresolved after the 35-day notice period, it will be settled through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules — not in court.

No class actions. All disputes must be resolved on an individual basis. You expressly waive any right to participate in a class action, mass arbitration, or representative proceeding of any kind.

Intellectual property. Disputes involving ELMIUR's intellectual property rights — including trademarks, copyrights, patents, and trade secrets — will be resolved in a court of competent jurisdiction, not through arbitration.

Governing law. These Terms are governed by the laws of the State of Wyoming, United States. All arbitration proceedings are subject to the Federal Arbitration Act.




11. General


If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary and replaced with a valid provision that reflects its original intent. All remaining provisions continue in full force and effect.

These Terms constitute the entire agreement between you and ELMIUR regarding your use of the Website. No waiver of any breach is effective unless made in writing by ELMIUR.




PART II — BUYING FROM ELMIUR


12. Who Can Buy


Our Products are intended for personal, domestic use only — not for resale or commercial purposes. By placing an order, you confirm that you are at least 18 years of age and have the legal capacity to enter into a purchase contract.

Shipping costs are calculated based on your location and selected shipping method, and are displayed clearly at checkout.




17. Risk and Ownership


Risk of loss or damage to your order passes to you when it is handed to the carrier. Please ensure your delivery address is accurate and complete — we are not responsible for orders lost due to incorrect address information.

If your order arrives damaged, please contact us and we will work to resolve it in line with our Return and Refund Policy.

Ownership of the product does not transfer to you until full payment, including any delivery costs, has been received by ELMIUR.

The same dispute resolution process in Section 10 applies to purchase-related disputes — email us first, then formal notice, then AAA arbitration if required. All disputes are handled on an individual basis only. Class actions are not permitted.
